The agreement
These Terms of Use are the agreement between you and Individual Entrepreneur Dzmitry Matatau, a sole proprietor registered in Georgia under identification number 300435330, with the registered address Building 54a, Apt. 46, III Quarter, XI Micro-District, Zvezsubani Settlement, Nadzaladevi District, Tbilisi, Georgia (“Homio”, “we”, “us”), covering the Homio mobile app, this website, and everything we offer through them (the “Service”).
By installing or using Homio you accept these terms. If you do not accept them, do not use the Service.
How we handle your data is described separately in our Privacy Policy, which forms part of this agreement.
Who may use Homio
You must be at least 16 years old and legally able to enter into this agreement. If you use Homio for a business, you confirm you are authorised to bind that business to these terms.
You may not use the Service if applicable sanctions or export laws prohibit us from providing it to you.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Homio on devices you own or control, for your own personal or internal business use, for as long as you comply with these terms.
You may not:
- copy, sell, rent, sublicense or redistribute the app or any part of it;
- reverse engineer, decompile or attempt to derive our source code, models or prompts, except to the extent that law expressly permits it;
- access the Service through automated means, scrape it, or build a competing product on top of our API;
- remove or obscure any proprietary notices, or circumvent our token limits, rate limits or paywalls.
On iOS, this licence is granted subject to Apple’s Licensed Application End User Licence Agreement. Apple and Google are not parties to this agreement, are not responsible for the Service, and have no obligation to provide support for it — though Apple and its subsidiaries are third-party beneficiaries entitled to enforce these terms against you.
Your account
Homio does not use sign-up forms, email addresses or passwords. Your account is created automatically from a random identifier generated on your device and stored in your device’s secure storage.
This is convenient, and it has a consequence worth understanding: your account is tied to your device. If you lose the device, reset it, or uninstall the app in a way that clears its secure storage, you may not be able to recover the account, your designs, or unused tokens. Purchases can normally be restored through the App Store or Google Play, but content and balances may not survive.
You are responsible for anything done through your device and account.
Your content, and the licence you give us
“Your Content” means the photos you upload and the prompts and instructions you write. You keep ownership of Your Content. We do not claim it.
The licence you grant us
“Your Content” also includes the messages you write to the in-app design assistant and the photos you attach to them.
To run the Service we need permission to handle Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, adapt and process Your Content, and to pass it to the AI providers and infrastructure providers described in our Privacy Policy, for one purpose only: operating the Service and producing the designs you ask for. This licence lasts as long as you keep the content in Homio and ends when you delete it or delete your account, apart from copies that persist briefly in backups.
We do not use Your Content to train AI models, and we do not use it publicly or in marketing. Before the first photo leaves your device, the app shows you a short notice about this processing and asks you to confirm it; declining simply keeps the photo on your device.
What you promise about Your Content
- you own it or have the rights to it, and uploading it does not infringe anyone else’s copyright, privacy or other rights;
- you have the agreement of anyone identifiable in a photo you upload, and you do not upload photos of children;
- it is not unlawful, and it does not contain sexual content involving minors, content that promotes violence or hatred, or anything you are not allowed to share.
The designs Homio generates
As between you and us, and to the extent we can grant it, you own the images Homio generates from Your Content and may use them personally and commercially. Two limits apply: AI output is generated from statistical models and similar output may be produced for other users, so we cannot promise it is unique; and your rights are subject to the terms of the AI providers we use, and to whether AI output is protectable at all under your local copyright law.
Acceptable use
Do not use Homio to:
- break the law, or infringe anyone’s rights;
- create sexual content, content involving minors, hateful or harassing content, or content designed to deceive or defraud;
- generate images of real, identifiable people without their agreement, or to impersonate anyone;
- attack, overload or probe the Service, our providers, or anyone else’s systems;
- resell generations, share an account, or otherwise use the Service in a way that is plainly outside normal personal or business use.
Our AI providers apply their own content filters. A generation may be refused for that reason, and a refusal is not a defect in the Service.
What AI-generated designs are — and are not
Homio produces illustrative visualisations. They are not architectural, engineering, structural, safety, planning, legal or financial advice, and they are not a design document.
The images are generated by AI models from a single photo. They do not measure your space. They do not know what is behind your walls, what your building regulations require, what your load-bearing structure is, whether a window can be moved, what anything costs, or whether a product exists. Dimensions, proportions, materials, lighting and furniture in a generated image may be inaccurate, physically impossible, or simply invented.
Do not rely on a Homio design for construction, renovation, demolition, purchasing or safety decisions. Before you act on an idea, have it checked by a qualified architect, engineer, surveyor or contractor, and confirm the applicable regulations yourself. Any decision you take on the basis of a generated image is yours.
AI output can also be inconsistent. The same photo and the same prompt can produce different results, and quality varies. That is the nature of the technology, and it is not a fault for which we owe a refund beyond what section 9 and the app stores provide.
Tokens, subscriptions and payment
Tokens
Generations are paid for with in-app tokens. Tokens are a limited licence to use a feature of the Service; they are not money, not property and not a stored-value instrument, they have no cash value, and they cannot be transferred, exchanged or redeemed for cash. Tokens spent on a generation are consumed even if you do not like the result. If a generation fails for a technical reason on our side, we restore the tokens it cost.
Subscriptions
Homio subscriptions are sold and processed by the Apple App Store or Google Play, using their payment methods and their terms. We use Adapty to verify purchases and unlock the corresponding access. We never receive, see or store your card number or bank details — the store handles the payment end to end.
Prices are shown in the app before you buy, in your local currency where the store supports it, and may include taxes. We may change prices; a change never affects a subscription period you have already paid for.
Auto-renewal, cancellation and refunds
Subscriptions renew automatically at the end of each period until you cancel. Your store charges you within 24 hours before the current period ends, at the price then in effect.
Cancel through the store, not through us. On iOS: Settings → your name → Subscriptions. On Android: Google Play → Payments and subscriptions → Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you already paid for. Deleting the Homio app or your Homio account does not cancel a subscription.
Refunds are handled by the storeunder its policy — Apple through its “Report a Problem” process, Google through Google Play. We cannot issue refunds for store purchases ourselves, though we will help where we can: write to [email protected].
If you ask Apple for a refund, we may tell Apple how you used the purchase. Apple asks the developer for that information before it decides, and answering it is the only way we can put your actual use of the app in front of that decision. By accepting these terms you agree that, when you request a refund for a purchase made in the app, we may send Apple data about your in-app purchase activity: the time since you installed the app, how long you have used it, an anonymous account identifier, whether the purchase was consumed, whether it included a trial, the total you have spent and the total already refunded to you. We never send your photos, your designs or your messages. You can withdraw this permission at any time by writing to [email protected] — we will then answer Apple without your data, and Apple decides on its own records.
If you are a consumer in the EEA or the UK, you have a statutory right to withdraw from a purchase within 14 days. By starting to use tokens or a subscription immediately, you ask us to begin performance during that period and accept that the right to withdraw is lost once the digital content has been fully supplied. Your statutory rights against the seller of record are not affected.
Availability and changes to the Service
We work to keep Homio available, but we do not promise uninterrupted service. We may change, suspend or discontinue features, models, styles or limits — including the AI provider behind a feature — to improve the product, control cost or comply with the law.
If we discontinue the Service entirely, we will give reasonable notice in the app and stop charging new subscription periods.
Our intellectual property
The Homio app, website, name, logo, design system, prompts, models as configured by us, and all related software remain ours and our licensors’. Nothing in these terms transfers any of it to you beyond the licence in section 3.
If you believe something on the Service infringes your copyright, write to [email protected] with enough detail to identify the work and the material in question, and we will investigate.
Suspension and termination
You may stop using Homio at any time, and you can erase everything from Settings → Delete account.
We may suspend or terminate your access if you breach these terms, if we reasonably suspect fraud or abuse, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to put it right. If we terminate your account for a breach, unused tokens are forfeited; if we terminate it for any other reason, we will refund or restore what is fair in the circumstances.
Sections covering your content licence, disclaimers, liability, and governing law survive termination.
Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.
We do not warrant that generated designs will be accurate, realistic, buildable, unique, or suitable for any purpose — see section 7.
Some jurisdictions do not allow the exclusion of implied warranties. If you are a consumer, you have statutory rights that these terms cannot limit, and nothing here removes them.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, lost designs, business interruption, or the cost of construction, renovation or remediation work undertaken on the basis of a generated image.
Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and fifty euros (€50).
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. If you are a consumer, this section applies only to the extent your local law permits.
Your responsibility to us
You agree to cover our reasonable losses, damages and legal costs if a third party brings a claim against us because of Your Content, your use of the Service in breach of these terms, or your infringement of someone else’s rights. This does not apply where the law prevents it, and we will tell you promptly about any such claim and let you take part in its defence.
Governing law and disputes
These terms are governed by the laws of Georgia, without regard to conflict of law rules. Disputes will be brought before the competent courts of Tbilisi, Georgia.
If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and you may bring proceedings in your local courts. EU consumers can also use the European Commission’s online dispute resolution platform.
General and changes to these terms
We may update these terms as the product and the law change. The date at the top always reflects the current version, and we will notify you in the app before a material change takes effect. Continuing to use Homio after that means you accept the new terms; if you do not, stop using the Service and delete your account.
If a provision of these terms turns out to be unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver of it. You may not transfer this agreement; we may transfer it as part of a merger, acquisition or sale of assets. Together with the Privacy Policy, this is the entire agreement between us about the Service.
